General Conditions of Sale

Object and Scope of Application

  • All sales of products made at Herdade da Amada, between the customer, as buyer, and Herdade da Amada as seller, are regulated by the General Terms and Conditions of Sale. These conditions apply both to visitors and to any commercial transaction carried out through our Online Store;
  • Product research, as well as its purchase, is subject to acceptance of the General Conditions of Use, defined by Herdade da Amada;
  • Herdade da Amada will consider “Customer”, “User” or “Buyer” any individual who purchases products or services in the Online Store;
  • Taking into account the growing evolution of online shopping platforms, Herdade da Amada may, at any time and without prior notice, change the aforementioned Conditions of Use. Under the same conditions, the information and commercial offer regarding products, prices, commercial conditions and promotions may be modified;
  • All orders placed by users that do not comply with the General Conditions of Sale of Herdade da Amada may not be considered, and the Company has the right not to process them;
  • The “Client” must always provide a valid email address or telephone number, which allows Herdade da Amada to contact the “Client” whenever appropriate. This contact is previously accepted and authorized by the consumer.


Commercial Policy

  • The customer will always have the right to terminate the Purchase and Sale contract, under applicable legal terms, if the product or service information presented in the Online Store does not correspond to their characteristics;
  • Any change in the price and characteristics of the product does not require prior notice;
  • The consumer must be aware of and accept the General Terms and Conditions of Sale of Herdade da Amada, before validating their purchase request or order;
  • All data recorded by Herdade da Amada is proof of the set of transactions carried out between Herdade da Amada and the “Client”.
  • All products present at Herdade da Amada are the property of the same until payment is made by the consumer for their purchase.



Prices

  • All values ​​presented at Herdade da Amada are already subject to Value Added Tax (VAT);
  • At the end of the online purchase process, the customer will be presented with a final price that includes the value of the products, Value Added Tax and delivery costs, if applicable. The invoice for the purchase will be delivered together with the order;
  • The prices of the products presented at Herdade da Amada are listed in Euros and the only change to the final price will be taking into account transport costs, or the granting of a promotional discount if applicable.


Responsibility

  • Herdade da Amada shall only be liable for damages suffered by the “Buyer” if such damages result from breaches attributable to Herdade da Amada’s contractual obligations towards the “Consumer”, or if liability results from applicable legal law;
  • Any damage suffered by the consumer as a result of inappropriate use of the products will not be the responsibility of Herdade da Amada;
  • Herdade da Amada assumes no responsibility in the event of violation of the legislation of the country where the order is delivered. The customer must check with the local authorities the conditions for importing or using the products they wish to order.


Intellectual and Industrial Property

  • All texts, comments, works and images reproduced or represented in Herdade da Amada are strictly reserved under copyright and intellectual property rights, for the entire world;
  • Accordingly and under the terms of the Intellectual Property Code, the use of information for private purposes is only authorized, subject to contrary provisions, including more restrictive provisions contained in said code;
  • Any reproduction or representation, in whole or in part, of Herdade da Amada or the elements included therein is strictly prohibited;
  • The company names, brands and distinctive signs reproduced at Herdade da Amada are protected under the legal provisions applicable to industrial property. The reproduction or representation of all or part of any distinctive signs is strictly prohibited and must be subject to prior written authorization from the owner of the Herdade da Amada brand;
  • If the “User” wishes to use information or materials from the Online Store, he/she must obtain prior written authorization from Herdade da Amada.


Applicable Law
  • These Terms and Conditions and all disputes arising in relation to these general conditions, including their validity, the use of the online store www.herdadedaamada.pt or any purchase therein shall be governed by Portuguese Law;
  • In the event of a dispute regarding the interpretation or execution of these Terms and Conditions, Herdade da Amada and the “Buyer” undertake to endeavor to obtain an amicable solution, which is fair and appropriate, within a maximum period of 60 (sixty) days from receipt of the communication addressed for this purpose by any of the parties involved;
  • In the absence of an amicable solution, under the terms set out in the previous number, and in the event of non-compliance with these Terms and Conditions, both parties establish the Court of Elvas as the competent jurisdiction, expressly waiving any other.
